2. Takedown Notice Requirements #
To submit a valid takedown notice under 17 U.S.C. § 512(c)(3), your written notice must include all six of the following elements:
- 01A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
- 02Identification of the copyrighted work claimed to have been infringed — if multiple works are covered by a single notice, a representative list of those works.
- 03Identification of the material that is claimed to be infringing or to be the subject of infringing activity, and that is to be removed or access to which is to be disabled — with information reasonably sufficient to permit us to locate the material (such as the full URL).
- 04Contact information for the complaining party: name, address, telephone number, and email address.
- 05A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- 06A statement that the information in the notice is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.
Upon receipt of a compliant notice, we will act expeditiously to remove or disable access to the identified material and will notify the user who posted the content.
3. Counter-Notice Requirements #
If material you posted was removed in response to a takedown notice you believe was submitted in error or misidentification, you may submit a counter-notice under 17 U.S.C. § 512(g)(3). Your counter-notice must include:
- 01Your physical or electronic signature.
- 02Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
- 03A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- 04Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, for any judicial district in which Really Solved LLC may be found), and that you will accept service of process from the person who provided the original takedown notice or an agent of that person.
- 05Any other information required by applicable law.
Upon receipt of a valid counter-notice, we will forward it to the original complainant and may restore the removed material no sooner than 10 business days and no later than 14 business days after receipt, unless our designated agent first receives notice that the complainant has filed an action seeking a court order.
4. Misrepresentation Warning #
Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees incurred by the alleged infringer, the copyright owner, or their licensees. ReallySolved reserves the right to seek damages from parties who submit abusive or bad-faith notices.
Please do not submit takedown notices for competitive, retaliatory, or other improper purposes. We take misuse of the DMCA process seriously.
5. Repeat Infringers #
In accordance with 17 U.S.C. § 512(i), Really Solved LLC maintains a policy to terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of copyrighted works. We reserve the right to terminate any user's access to the platform at any time for repeated infringement or abuse.
